  • Lowell Portfolio Ltd vs S Lonie - Question about discontinued case.

    Hi Everyone,

    I posted previously regarding this case that was discontinued in court, but i have a question.

    Lowlife solicitors did not provide information that i had requested after paying my statutory fee of £1 (and still havent), i have since checked my credit file, and this is listed on there from lowell, at the amount that they stated on the county court papers, which included court fees etc.

    My question is this. If Lowell havent been able to provide statutory information to me regarding this case, that was discontinued in court, can I get this amount, and allegedly defaulted account removed from my credit file? If I can, how do I go about doing this? Is there a templated I can send to Lowlife requesting they remove it, as they have failed to prove the debt?

    a default listed and a true fact stays on there up to 6 years in england/wales 5 yrs scotland, the default stays as a true record, lowells should revert to original default amount, they try it on but you could on the CRA disute on the page it is listed/

      Is this the case even though they havent proved the debt is mine, I have no recollection or record of what this is - that was my defence to the courts when Lowell tried to issue me with a CCJ

        Hi slonie

        CRA records are not held to be 'enforcement' (see McGuffick v RBS [2009]), but they must be accurate.
