    Hi another Lowell portfolio debt topic, i've spent some time reading through online and on the forums about this company and come across template letters which should be sent but I would not know what to do once I got reply. So to sum things up around 8-9 years ago somebody took out a vodafone contract on my name which I think went through their fraud team and after a few months I rang up to see if a file on my name existed which it did not. So I thought it had all been sorted until a few years ago Lowell Portfolio started sending mail to my house saying I needed to repay 800 pound and they had bought the debt from vodafone. So I originally ignored it and they kept going away and coming back under different names. They're now back under the name "Lowell Solicitors" and have begun texting me on my mobile for me to get in touch. Now from what i've read any debt like that would be statute barred and i'm just looking for some guidance to which template letter I should be looking to send as it's become really annoying now that I would just like to get the FCA involved as it is a form of harassment.       Good morning,

      Lowell Solicitors is the in house " legal " department of the Lowell Group of companies.

      Is the letter received a " letter before claim" ?

      Statute barred in England and Wales means that there have been no payments or written acknowledgments of a debt in a 6 year (5 In Scotland) period.

      Have you checked you credit reference files to see if this account is still reported? If not you can check Noddle and Clear Score free online.

        If you never opened an account with Vodafone then claiming the account being chased by Lowells is Statute Barred may not be the best way forward.

        I would write a nice polite letter to Lowells simply stating that you have never had an account with Vodafone and ask them to provide evidence to the contrary.

        I would then consider a Subject Access Request to Vodafone to get the full history of this account which you say was closed by their Fraud Team. That will give you the evidence you need. If they say there's nothing on file to link you to an account with them that will be useful too (as long as they send you back your £10 fee )

        If legal proceedings are issued by Lowells then perhaps include the SB argument as an 'alternative' but it's hard to say you've not paid into or acknowledged the debt for more than six years if you never had an account with them in the first place (if you follow me).
