    hi everyone my son lives with us and on 11th 4 2017 we had hceo come to our address for a enforcement of a ccj The date of the court case was 1/12/2016 he was unable to attend and a email was sent to the court .The case was dismissed against him.On emailing the court they said it was a mistake the case was proved against him.The high court enforcement officers went away after seeing the letter he had from the court before they left they said they wanted the whole amount or they would take goods from here .When told it was our home and he did not own anything they said we had to prove every thing belonged to us and not him .We have been married 45 years and do not keep receipts i must add he is a drug addict .I am a pensioner and suffer from severe chronic pulmonary obstructive disease and do not know what to do now.Before they left they said they would get a van to remove goods when they came back they never left any paperwork as they were using a tablet. can anyone give us any advice on what to do when they return i have been worried sick.thank you

      Did he receive a Notice of Enforcement from the HCEO before they attended? If so what date was on it & when was it received, also what date was he given to make contact by?

        No he has not had anything only the letter from the court saying the case against was dismissed which turned out to be a mistake from the court.

          In that case it would appear that Enforcement is non-compliant. Can I ask who the HCEO is?

          On top of what is said above the HCEO is only carrying out the instructions of the Creditor. In this case it appears to be that they still think they have a live CCJ that can be enforced against. You are going to have to contact the Court to find out exactly what is going on, if the CCJ was issued in error then they have compounded that by not quashing it. Time is of the essence as if nothing is done then a return visit from the HCEO will ensue.

          Depending on what happens will decide to route you are going to have to go. Court applications can be made but if the Court has made a mistake then I don't see why you should have to pay for the applications.

            thank you he will be going to courts on monday will let you know the outcome sorry do not know who hceo was as i did not deal with them.
