Hi

Just a quick question, i am being taken to a small claim court and a court date has been set, the court ordered that all documents needed to be exchanged by 11th April 2017, i was sent the claimants documents yesterday the 10th April everything on this was correct but the Claim Number and Court was all incorrect, so today at 16.20 i sent this back stating the incorrect claim number has been added to all documents and the wrong court. I then received at 17.30 a correction witness statement saying it was a management system error......as this was sent after 16.30 do i have a right to email back and state that as this has been sent after 16.30 i am not accepting the correction as its would now been classed as 12th April ?

Is this question in relation to your other thread for a claim?

      It looks like it maybe.

I'll reply once you've clarified things.

You may need to merge the two threads if they are about the same claim. Ask Kati if she can help you with this task

From what you say the Claimant has complied with the court's Directions to file their WS by today (11th April).

Your question is whether the court would accept their WS as admissible since it was served on you at 5.30 pm.

Did they file their WS at court by 4 pm even if they didn't serve it on you until 5.30 pm?

If you've made any mistake it was to tell the Claimant that they had made a mistake with the facts stated on their WS which enabled them to remedy the situation.

More importantly, have/did you file and serve your WS before the deadline?
