  • Buying Freehold

    Just some clarification please

OH owns the leasehold to a property. There are 8 properties , 4 downstairs 4 upstairs , a total of 8 maisonettes

OH extended the lease a couple of years ago and today i found out 4 others have also extended. Apparently when they extended en masse there was some talk of them buying the freehold.

My understanding of the law is that to buy the freehold you need more than 50% so in this case 5 out of 8 - is that correct or is a basic 50% enough?

Second point, my understanding is that all the leaseholders need to be given the chance to join the freehold purchase , is that correct ?

In summary ,, can 4 or 5 of the leaseholders (depending on answer to 1st point) present a fait acompli? My reading is no they can't, the offer has to be made to all leaseholders although it may be made up of higher prices for those that have not extended and little to nothing for those that have Am I right or worng ?

Finally can any freeholder change the terms of the lease without consent? I say no , am I correct?
