    hi just wondered if you could help, I currently have car finance through gmac, due to losing my job I am now unable to make anymore payments, I have paid over 50% and have tried to vt however due to the car having a rattle on the timing chain they are refusing to take the car and now saying if I cant afford payments then I should voluntary surrender, is this correct, thank you

    Hello,

    They can't refuse a VT because there is a possibility something is wrong with the car. The right to Vt is set in law and you have a right to VT regardless, they are misleading you and that is wrong.

    Is there actually an issue with the timing chain and have you sought a price to fix it?

      Hi, Recently approved by finance co. to VT.
      Followed all procedures/templates etc on this forum.
      Have now been summoned to appear in court in relation to Excess mileage charges. Have no option now but to seek legal advice.
      Is there any proven cases known to anyone that gives me any hope against a finance company?

        Hi NH1 what stage are you at? Have you only received the claim form, or have you submitted a defence, or are you at a later stage? It would be helpful to know this before I can comment any further.

        if you can also tell us who the lender is or if you can upload a redacted claim form that would also be of help

          Meeting solicitor tomorrow to discuss submitting my defence. RCI Finance is the lender.
