  • Dca threatening ccj but I have no income, can my partner be forced to pay?

    Hi,

Not sure if I've posted in the right place...
Restons Solicitors (on behalf of capquest) have sent me a letter threatening to take me to court if I don't come to an arrangement to start paying the debt (I owe just over £1000 for a catalog). The problem is I don't have any income, I haven't worked since Dec due to health issues (sever anxiety diagnosed by my gp). I don't claim any benefits due to the fact my partner works and has a good income so I think I would be rejected if I applied. I'm not married but co habbiting, no kids and currently privately rent from partners parents, I have no savings nor any assets such as a car (partner uses a van owned by his employer).

My partner offered to pay £30 a month on my behalf so I rang Restons on Monday to explain my situation, the agent was very rude and demanded i give all my partners details (his income, his outgoings etc) I refused to do this as the debt is solely in my name. The agent said that without me giving this information they reject my offer of £30 payment.

My my question is - if Restons apply for a ccj can the court force my partner to pay this debt despite not being named on the debt?

    The debt is yours alone.

Thank you so much for such a prompt response So does that mean the court won't force my partner to pay if Restons apply for a ccj?
