  • BW Legal sent County Court Claim

    Hello
    I was getting letters from Lowell ltd. regarding a debt which I don't acknowledge, so I ignored them. Recently BW Legal started claiming for the same debt n asking to contact them. I ve been getting letters n even phone calls which I had been ignoring. Yesterday I received a County Court Claim Form for the same. Also received a letter from BW Legal stating that if I don't respond to their letter or the Claim form, they ll enter a CCJ against me.
    Where I can recall, their claim is way back from around 2007. After which I was not in the country for few years and I came back 7years ago and to a different address. In any circumstances if I had an arrear won't it be statute barred by now.? But my credit report shows a default on 2011.
    I have written a letter to BW Legal to provide me with the proof of contract with my signatures.
    Can you plz advice me on how to deal with the Court claim form and BW Legal?

      Hi Poki12 & welcome to LB

      First & foremost, acknowledge the claim asap per claim pack instructions.
      For the time being, defend in full.
      If you live in England/Wales do not contest jurisdiction.
      Do not enter any dialogue in the 'defence' box.

          Hello Charitynjw...
          I have made the Acknowledgment of service online.
          what should I do next.? I m not familiar about the legal bits at all. I have read everything online but it all seems too complicated. I would rather have someone tell me what to do.

            Hi again.
            After I made the AOC and also filed my defence on 5 th April saying that the claim is statute barred I did not hear from them till this 22nd may. Now I ve got a Small Claim Directions Questionaire to fill. I have also received today the copy of the claimants DQ proposing to refer the case to Small Claims Mediation service.
            Please can u help me what to do?

              Ok

              What is the alleged debt for? (Eg credit card, overdraft, mobile 'phone etc).

                It's a debt from Hfc credit for a product we bought around in 2007 or 08..

                    You can complete it, scan it & send as an email attachment.
                    ccbcaq@hmcts.gsi.gov.uk
                    Put [Claimant] v [Poki12] Court Claim no [XXXXXXXX] in the subject box
                    Put 'Completed Directions Questionnaire' in the email content.

                            depends what happens now & later on - some companies hope you give in or discontinue, time will tell, every case can be different result?

                              I ve also received an EX730 telling about how the Mediation service. Should I consider it.?
                              should I send a copy of the DQ to BW Legal too?
