    My point was that Varde was not a 'credit giver' so they would not have your credit agreement unless MBNA gave it to them which I doubt unless you sent a CCA Request to Experto Credite at some stage?

    Also Experto Credit went into voluntary liquidation just before last Christmas so I'm surprised to learn that PRA claim they are currently in touch with them.

    Would you be kind enough to post up a redacted copy of that letter so I can see the exact wording?

    I'm not being nit-picky - I do have a good reason for asking (ongoing research) but I'm not saying why at this point in time.

          For them to admit at this stage the debt is unenforceable suggests to me they may have lost a previous case???

              Hi Jack,

              I was pleased to hear your news from PRA that your debt is unenforceable (assuming that this turns out to be true).......you must be sooo relieved .......keeping my fingers crossed for you!

              My situation is clearly more advanced given that these idiots have already initiated the CCJ. I am so angry about their underhand tactics especially as I have never missed the £1 payment and the 'default' is purely because the payments are still (as of Friday) being returned.....how can this even be a default, let alone warrant a CCJ? Keep an eye on my thread for any developments

              I will continue to look in on how your case progresses.....maybe some of the actions may assist me in due course.

              Anyway, delighted that things appear on the up for you....

              Best wishes for a speedy, final debt dismissed outcome!!!

                They say if I dont get it after 12 working days, the debt will be classified as Unenforcable until they do get me the Information

                      It is indeed interesting as I thought it would be.

                      It states that Varde Experto don't have the credit agreement but it doesn't say why they didn't ask MBNA for it since they are the original creditor.

                      I wonder if this is an isolated letter or even an error/typo or whether it's a new 'trend'.

                      What's the date on that letter (PM me with it if you prefer)?

                          hi the lettter was sent on 28th Feb, I Can supply all letters I have had from them, It will be intersting to see what they do on the 14th if they phone I wil do them for harresment as I have asked them never to phone me.

                                I'm trying to keep you out of trouble by saying don't provoke them into issuing a claim unless you're 110% certain you have a cast iron Defence.

                                Thats not been established yet if ever.
