  • UKPC - rejection of appeal - ? appeal to POPLA - advice please

UKPC - PNC incurred 9.12.16 on retail park for "not parking correctly within the markings of the bay or space". This is not a pay and display site. I wrote to UKPC on 15th Dec 'without prejudice' stating I would not pay this invoice because of inadequate signage - signage on entrance merely stated no parking on match days (it was not a match day), the nearest mounted sign displaying T&Cs was about 50 yds away turned away from entrance, clearer sign near to turned away sign merely stated '2 hour maximum stay.' I only shopped for approx 15 mins and have the receipt to show I did give the stores some custom.

I parked at the entrance to the car park - this is at least 3 cars in width - hence no obstruction to motorists. There are no markings on the wall or ground to state I am unable to park there.

I have argued that as the T&Cs are not clearly and visibly displayed at the entrance, I did not enter into a contract with UKPC and therefore not agreed to their terms. I also argued that the amount claimed £60 (early payment) or £100 in the invoice is completely disproportionate and not a pre-estimate of loss - this is a free car park!.

I received a Notice to Keeper on the 12.01.17
3.2.17 - sent copy of my 15th Dec letter and stated I had received no reply to that letter.
27.01.17 - Final reminder from UKPC (letters crossed in post)
    31.1.17 - UKPC rejects appeal
17.02.17 - UKPC reminds me of the rejected appeal and states "UKPC regularly takes motorists to court who ignore their parking charges."

Please advise - should I appeal to POPLA and if so can anyone, PLEASE, advise regarding content.

I have photos to support my assertion re: inadequate signage.

I wonder if the Mystery VIP member can help. He/she seems to have helped so many people.

I'm so worried but want to take a stand as I believe I have a case to argue.

PLEASE ASSIST if you are able.

    Thank you so very much.

So sorry - not too proficient with this - how do I delete personal details i.e. registration mark? Have it on desktop but won't allow me to delete. Sorry for being so thick (blame it on age).

        Thanks for responding.
