  • Please Help 1st Credit CCA request reply

    Hi Can you please help? I requested a CCA from 1st credit for a loan I took back in 2007. They have replied and seem to have all the right info.
    Thing is it can become statute barred this year. I don't know what to do as I'v no spare cash to give them we're already living off handouts.

    Please help

              Have you received a court claim from 1st Credit or are you worrying that may happen before this debt goes SB this year?

              Sometimes you can be sent documents which you think are tikety-boo at first sight but then they turn out not to be compliant under closer inspection.

              Who was the original creditor (loan provider) because some get things more wrong than others?

              Also there's more to winning a claim than just the credit agreement. Did you ever get a Default Notice? Have you had annual statements since you stopped paying?

              How much is Ist Credit chasing you for because if you haven't got any spare cash to pay them then they won't get any will they. You can't get blood out of a stone.

                I took a loan with Lloyds tsb in 2007 My husband took ill and I was made redundant I could not keep up the payments. I went into default and was paying reduced payments

                Then it went to collections and I was paying £10 per month I stopped paying in April 2012 and have had no probs till last week when 1st credit sent a copy of screen prints and some payments from the collections all this was with the cca. I am not trying to not to pay I really can't pay and I don,t want a CCJ as I am trying to get an p/t job and I am scared this will affect me as the only jobs seem to be in the shops.

                  Your poor thing. You've had to endure so much. Don't let a debt purchaser (1st Credit) bring you to your knees.

                  I note you live in Scotland where the legal process is a bit different but the statutory provisions of the Consumer Credit Act remain the same. Statute Barred kicks in after 5 years not 6 years too.

                  So just to clarify, you've not yet received a claim from the Sheriffs Court?

                      Well that's a relief to know it hasn't reached solicitors or the court stage yet.

                      Do you have any other debts?

                      What is the situation with your mortgage as that should take priority. The roof over your head matters more than an old unsecured loan which has come back to haunt you.

                        We are behind with it but its not a problem as we are getting to pay off the arrears slowly. They have been brilliant through this whole thing.

                          UPDATE:

                          1st Credit became aware of this thread and were so concerned about the OP's fragile health, that they contacted LegalBeagles to offer direct help. As a result of this, the entire 13k debt is no longer being enforced against Landcruiser and the account has been closed.

                          If you are suffering serious ill health, including mental health problems, if you are being pursued for a debt you cannot pay, it would be sensible to make the debt company aware of your situation. (In writing, enclosing e.g. doctors letter) I have now witnessed several lovely incidences like this in the last year from 1st Credit and Lowell Portfolio. There are new requirements of such companies to treat vulnerable people fairly and in my direct experience, WHEN they become aware of the issue, they behave very honourably.

                          So a big thank you to 1st Credit for intervening so brilliantly in this case, Landcruiser still has a lot to battle through, but one huge part of her worries has been obliterated simply by honestly sharing her problems here. I wish her every success going forward, she really deserves it. xxx
