            So how are things going?

            Hopefully the calls have stopped unless they're chasing another debt. They'll stop eventually if you don't answer them and then they'll switch to correspondence which is easier to handle.

            Have you received any response to your CCA Request or your CPR 31.14 Request?

            Sending a SAR to MBNA can only help your case in the long run so try to find the strength (and the £10 ) to do that on Monday.

                CCA not come back yet but received letter to say when they receive documents they will send .

                      I get 5 or 6 calls a day now from 4 different numbers one is a local number which apparently is an option available to users to fool people it may be someone local (so BT has told me).
                      Had a letter from PRA telling me the documents requested have been applied for and will be available in due course.
                      I will send a SAR on Monday to MBNA

                        Oh good, PRA have admitted that they don't have the credit agreement in their possession at the moment.

                        Keep an eye on your Defence filing deadline regardless of whether they are still unable to produce it by then. It's the court timetable you need to stick to now.

                        The deadline will be 33 days from the claim Issue Date.

                            Hi everyone I would just like to thank everyone for their input.

                            I am just about to prepare my defence for this court claim.

                            Can I file my it all on line? I filed acknowledgment on line.

                            Do I have to send a copy to PRA?

                              Have sent my defence in and had aknowledgements from PRA about CCA Request and CPR 31.14 Request? Information to follow
                              but at this present time the debt is unenforceable,and will remain as such until they able to comply fully with their obligations.

                              Is this good...? sounds good or am I just too hopeful .

                              Also they say original client was Varde Experto dont know if this is significant I cant remember I thought it was MBNA so confusing.

                              I realise everybody will be busy but any help and advice would be much apreciated

                                Especially since Varde Experto was NOT the original creditor.

                                Interesting that PRA have not mentioned that assignment (from MBNA to Varde) in the Particulars of Claim . . .
