    Hi all just after some advice regarding this company. They are claiming i have a payday loan debt - about 5/6 years ago I stupidly took a couple out to try and help me out when times were hard but can't be sure that this is one. I have since moved address and haven't received any letters to my current address. I have however received a fee emails offering me payment plans etc even a 50% discount if paid in 2 months. I have ignored all these e-mails.

    My question is if one of thier agents visited my property would I have had a letter pushed through the door? My partner sent me a picture of a strange car parked outside my house yeaterday and said a man knocked the door a couple of times. She didnt answer as she is a very nervous person. The car was there atleast 20 minutes obviously it could be totally innocent and unrelated but it just got me a bit stressed.

    If the payday loan is one I took out it could possibly be from wageday advance. As i already said at the time I would have taken it when I was struggling and would have cleared the balance to take another loan out straight away on a rolling monthly basis and just by ticking a box online I believe no checks as to wether I could actually afford to repay this would have been carried out. Could this be a ground to get it wiped off?

    Good morning, welcome to LB,

    MMF have a very poor reputation regarding their conduct and attitude to alleged debtors.

    They we heavily criticised and sanctioned by the OFT a few years back. Also they had to refund /compensate a number of individuals.

    I doubt any MMF representative would leave any form of " calling card" it's not their style.

    You should send MMF a request for a copy of the agreement for the alleged loan. (CCA Request). There's a £1 statutory fee for this, use a postal order marked " for statutory fee only" and use signed for post so you can check delivery date.

    You are not obliged in any way to enter into a dialogue with any stranger who turns up on your doorstep invite them politely to leave your property if they refuse call the police and say you feel threatened.

    Does this alleged debt appear on your credit files? You can check Noddle and Clear Score free online.

      Any chance you could be more exact about this? If it may have been more than 6 years ago, a payday loan debt is likely ot be statute barred.

      If it is just coming up to the 6 year statute barred point, then you may decide it's better to do nothing as MMF don't seem to have your current address. This isn't an altogether safe strategy as MMF may try to get a CCJ for the debt at a previous adress.

      You need to read https://debtcamel.co.uk/payday-loan-refunds/ to see if you may have a possible "affordability" complaint. If you only had one loan from a lender this is very hard to win. But if you repaid the loan and then borrowed again the same month a few times this would be a good case for getting a refund for the later loans (including the last loan which defaulted). A balance isn't usually wiped out but the refund may be larger enough to do that - especially as the ombudsman adds 8% interest on, which after 5 years adds up to quite a lot!

        Thanks for your replies I haven't been able to get on for a couple of days so sorry for the delay in replying. I will look at those links straight away, I'm sure it was a loan taken out atleast 3 consecutive months. I have received an email today which i will paste below.

          When sending the first emails should I include the my address at the time of taking out the loans and also state they have no right to contact me by any other means or regarding any other business?

                Careful if they issue a CCJ claim at the old address they have from you in an email you send you will not be able to defend it

                  I would only be giving my address to the payday loan company not MMF. Surely the loan company can't apply forma CCJ as they no longer own the debt?

                    This isn't a very sensible way to proceed. Baring in mind your affordability complaint may need to go to the Financial Ombudsman and you may need to supply bank statements and a copy of your current credit record, I think the chance of you being able to conceal your current address is not good.

                    Putting in a complaint to the original lender and then informing MMF that the debt is under dispute would seem to be a better approach if you want to avoid a CCJ from MMF.

                    Sounds a pointless sentence to me. They can contact you about any matter relating to your complaint, which would include the outstanding balance.
