  • Have left it to the last minute!

    Have had CL finance take me to court despite having no CCA produced as requested in writing with the £1 by recorded delivery, have been very stupid i did an AOS online to give me more time, but didnt think to send a request under CPR! i have tommorrow to submit my defence, i know no CCA is a defence but how do you word it ? please help

    oops u have left it rather late.

    When did you send the CCA ?

    And a bit more info on the debt would be helpful too.

      In that case a holding defence would be in order based on lack of information.

      This one can be adapted to suit.

      Basically just change the references to CPR to your CCA.

      I assume you have evidence that you actually sent it and they received it, ie recorded postage slips and online acknowledgement ?!

        Yes i have curlyben,so if i take out references to cpr and insert cca thats the holding defence?

        and do i then cpr them or is it too late?

          might be an idea to do it now, but you cant base your holding defence on it.

            Habe edited it and submitted on line, what if i didnt edit all i needed to, will it null and void it or as the fact that an agreement was asked for and never recieved as stated in that defence the important bit for holding? sorry if that doesnt make sense but submitted before viewing, my fingers are too fat!
