  • Jacobs Enforcement Agents

    Hello,

I am new to this site so a little unsure if I am posting in the right place.
Anyway I stupidly missed payments on my council tax. I had lost my job and we were struggling financially but yes my fault entirely. I received a letter from Jacobs telling me the debt had been passed to them and any future payments should be paid to them. I rang them to set up a payment arrangement and they asked for £220 per month, (we have an income of around £1200 as my partner had his hours reduced while there was no work) and at that time we had 2 children and I was pregnant.

Well after deducting essential bills we just simply didn't have that money. So eventually they accepted £120 which was still more than we could afford. We paid a few payments but we managed to default on a payment. I received a letter saying removal proceedings, if the above amount is not paid within 7 days of the above date 16.11.16 (arrangement hadn't been broken by this date and we didn't receive this letter until last week) we will enforce the warrant by our enforcement agent attending your premises with a view to taking control of your goods for sale by public auction. So bailiffs turned up at my house yesterday and just opened the door and as I have severe anxiety I couldn't go to the door to talk to them so I had to let them in and explained I had anxiety. They handed me a letter saying I had 24 hours before they would come back and take my possessions. I told them I didn't have anyone to help but they said if I told them that they would have to start clearing my stuff there and then. So I said I would try and they left.

I then rang later that evening to ask about him, was he sent from the high court? What were the next steps in the process? Would he break into my house if I was out doing the school run? He said I am not here to explain myself to you. If you don't pay by 9pm there will be a removals van outside of your house at 6am. I said I thought I had 24hours which would give me till 12pm the next day he said no I don't have to give you any time if I don't want to and slammed the phone down on me.

I finally sourced the money but I was too scared to ring back so I got my partner to ring. He didn't even answer just hung up. So we tried again this time he answered and simply said the removal team will be there at 6am before we could even say we were paying. He took payment and that was that.

Now because of my anxiety I didn't ask any questions when they were here, to be fair I didn't know what questions to ask. So basically I have handed over money to someone I know nothing about. all I know is he goes by the name Mr. K O'Neill.

All I want to know really is, is the scenario I described the normal procedure? I have no receipt of payment as it was done over the phone this wont backfire?

    TIA

Do you know what charges you paid? At any time was a Controlled Goods Agreement made listing goods they could remove?

I think there was a £235 fee for them visiting. No they didn't list any goods. They just came and one of them pointed at his vest saying that was proof he had been and handed me a removal of goods notice saying he was a certificated bailiff who would be removing goods in 24 hours if I did not pay. I told them I didn't have the money that is when he said he would take things there and then but he would prefer to give me the 24 hours so I should try to ring friends and family.
