  • Timescale for submitting a defence 2 bites of the cherry?

    Hi, a claim for non payment of a central heating installation was made against my mother.
    She filed her defence and counterclaimed.
    The claimant filed their defence to the counterclaim 2 months ago as directed by the courts before a certain date, which was very, very basic.
    Now 2 months later she has received a 12 page detailed defence.
    Its full of lies so she feels the need to reply to it in someway.
    1. Can the claimant file their defence then make a detailed defence some 2 months later after the date as ordered by the court?
    2. How can my mother reply to this pack of lies and put it on record so the court can see it.

    Have you received a Directions/Allocation Questionnaire yet?
    Has the case been allocated to track yet?
    Have you been notified of the hearing date & been given instructions re disclosure of evidence?

      Yes, we received a Directions/Allocation Questionnaire and completed it.
      Yes, the case been allocated to the small claims track.
      We attended a directions hearing on 08th November 2016 RE: expert evidence/settlement where it was agreed there was no need for expert evidence.
      The court was going to involve mediation.
      So, the claimant filed a defence to the counterclaim within the relevant time period on 27th September 2016.
      Then we attended court on 08th November 2016 as detailed above and now we have been sent a detailed defence (pack of lies) to our counterclaim.
      Hence our questions to this forum.

        If it were me I'd phone the court to check on the current status of the claim(s).
