    My wife is a mental health patient and I have been dealing with her affairs for several years.
    An old debt surfaced, (credit card I think), with a court summons (the standard northampton type). She had her breakdown in 2011 and I asked how long before that she had no contact. She said 2 or 3 years.
    I sent a defence back of 'Statute barred'.

    I now have a letter of referral to the small claims track and an offer of mediation.

    1. Does this mean that the claimant has a record of a payment?
    2. If they obtained a payment while she was seriously unwell does it stand?
    3. If she now enters mediation is she acknowledging the debt?
    4. If mediation is successful, does this mean that a CCJ is entered against her.

    I had no help from CAB because the copy of the summons has disappeared (wife,I think) and they said couldn't help without it.
    I have to reply by Monday 23rd Jan. I have found your site rather late but any help would be appreciated.
