  • Defending a claim - claiming expenses without counterclaim?

    Hi Everyone,

    In the event that i defend a claim and i have to attend a court hearing.

    If the claimant fails in obtaining a CCJ against me, if i include in my defence i would like to claim my traveling/accommodation expenses to the court or loss of wages is this possible or would i have to counterclaim for this?

    Just to keep you updated and encase anyone has the same query in the future. The claim was dismissed totally without merit and due to the claimant being unreasonable i was awarded my traveling expenses (with no counterclaim)

    I am not sure how it works if the claimant did not act unreasonably. It would be good to know if i would of been awarded anything in that event.

      There is no need to counterclaim. If you win you can get costs awarded from the other side, usually travelling expenses etc and up to £95 for loss of wages/holidays. Limited in small claims but more if the the other side has been unreasonable. Needs to be asked for sometimes.
