  • Lowells - Three Mobile Debt

    Hi

    I have been receiving letters from Lowells for some time now, which I have ignored. However, they are relentless to say the least and in the absence of any response have now written to me at my Father's address - which I haven't lived at for 15 years! I've no idea how they got that address, it would have dropped off my credit file a long long time ago.

    This letter (attached) basically says if we don't receive a payment by 25/12/2016 (Merry Christmas!), we may consider involving an external collections partner etc.

    Anyway, I'm getting a bit sick of them now and I don't want this turning into a Court Claim. (It's already a default on my credit file which will drop off sometime next year).

    So, do I owe the money? I MIGHT, I can't honestly remember, it was over 5 years ago, perhaps I did stop paying them mid-term... Perhaps I owe an early termination fee, I've no idea.

    In any case, I believe I have the right for them to prove what I owe - if that's the best course of action I could do with some advice on wording. I found one example of a Prove It letter but it makes reference to the FCA, and I don't think this is regulated.

    The other suggestions I'm seeing are to contact Three Mobile directly to tell Lowell to get lost and sort it out directly with them...

    What do you think?

    Sir / Madam,

    I am in receipt of various correspondence in regard to an alleged debt supposedly arising from an account with 3 mobile, please note I do not recognise any such debt and I do not acknowledge and liability to Lowell.

    I require written evidence of how the alleged debt arose and copies of any agreements or contracts Lowell may claim I have entered into with 3 mobile.

    No further correspondence will be entered into until such proof is provided.

    Amend as you see fit, it's just a suggestion.

        Im new to this site, i have a simular issue with Lowell and they sent me a court summons which i am fully defending . I sent them a £1 p/o and asked for any proof of contract and today i received a response stating that as its a mobile phone contract i had with t mobile going back to july 2011 they dont legally have to provide any evidence /[proof as by insertinf the sim into the phone counts as a contract!!!!
        so now im wondering what else to do??

          URGENT LOWELL sent a letter to me about a Vodafone bill outstanding. I do not recall having anything to do with Vodafone. I have checked my details on clear score and in there no records or history of Vodafone. We sent lowell a prove it letter and also court papers came with the claim form. We wrote a defence and sent it by special delivery. Today we received a letter from lowell and they say a telecom account is not regulated by consumer credit act of 1974. Therefore the original creditor is not obliged to provide us a copy of the agreement. It goes on to say further the account was taken out 27 August 2011 with a telephone number provided. It also says that they are no longer registered by the financial conduct authority. It says failure to respond to this will result in a ccj against my name. What advice could you give.

            Can you please post a copy of the letter after removing your name address etc.?

            They are correct about the account not being regulated under CCA 1974.

            Is this letter from Lowell Solicitors? Are they saying Lowell is no longer regulated by the FCA?

            Have you actually receive County Court Claim ( Form N1)?

              Hi nem. I received a claim form from lowell solicitors in Northampton. I did send a defence to court and have given me 28 days. Lowell sent me another letter saying they don't have to prove anything as they are not regulated by fca anymore. They sent me a mobile number which I don't recall. I have been on clear score and there is nothing for Vodafone. They said I owed airtime and defaulted again if I defaulted it would have been on my credit file right ??. Now I don't know what to do shall I go to lowell and accept it or fight it ??.

                According to the FCA Register 5 mins ago, Lowell Financial Ltd & Lowell Portfolio1 Ltd have interim permission.

                  Good morning Maria,

                  It would be very helpful if you could post a copy of that letter here after removing your name / address etc.

                  This could be another " dirty trick" to avoid providing documents.
