  • 21 days to accept an offer?

    Hi,

    I seem to recall reading somewhere in the forum that if one party in a Civil case makes an offer of settlement then the other party has 21 days to accept? Even if they initially turn it down?

    I think you are referring to Part 36 offers but they are not really applicable in small claims

      If the offering party has not served written notice of withdrawal on the rejecter, the rejecting party is entitled to accept despte his previous rejection see Gibbon v. Manchester City Council [2010] EWCA Civ 726.
