  • Asset Collections & Investigations v CliffIcon

    Received a claim? Yes
    Issue Date:
    3 November 2016
    Amount approx:
    £1169.70
    Claimant:
    Asset Collections & Investigations Limited
    Solicitor: Don't know

    Original Creditor:
    Lending Stream
    Particulars of Claim:
Is the debt Statute Barred? No
List any letters you have sent: CCA request, CPA request sent to claimant

    Particulars of claim:
Asset Collections & Investigation claim this amount in respect of an unpaid load funded by The Lending Stream. The defendant failed to abide by the terms of the contract. Asset Collections & Investigation purchased this debt from The Lending Stream and subsequently sent a notice of assignment to the defendant to advise.
The defendant has failed to respond from the Claimant thus denying the Claimant any opportunity in assisting the Defendant in attempting to bring the matter to an amicable Conclusion.
The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 21/06/2016 to 25/10/2016 on £1070.60 and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of £0.23

    Any Other Info:
I send the CCA and CPA on 8th November and I have today received four Fixed sum loan agreements for £250, £100, £100 and £50 dated between 29 March and 17 May 2014.

I took out a lot of pay day loans from around 2009 to 2014, including some from Lending Stream. I checked my bank statements from the period in in 2014 and I made several payments to Lending Stream, but it is likely the were other loans I had taken out just before the ones I have received agreements for. I don't know if I paid anything back towards these loans. I don't think I took out any payday loans after these four.

Are Asset Collections & Investigations required to supply full statements of these accounts and do I have any defence if we cannot be sure if I paid anything back towards these loans?

    Thanks

    Can anyone help?

Does the claimant need full account statements to proceed and can I defend if I cannot tally the amounts claimed for against how much I have paid back to the original creditor?

Hi CliffIcon & welcome to LB.

Is this a matter where loans were 'rolled over'?

Btw, have you acknowledged the court claim per claim pack?
      If not, do so asap.

I don't think these were rolled over loans, no. I have acknowledged the claim.
