  • Court fees FREE!

    Fortunately for me I am exempt from paying court fees due to my personal/financial circumstances.
    I have recently issued two N244 applications against a company.

    How can I make it so the other side has to pay these fees, or is it not possible?

    Example number 1.
    I was discontinued from a claim made by them against me.
    How could I have claimed the court fee back if I never paid it in the first place?

    Example number 2.
    If I succeed in my claim against the company for malicious prosecution, How is it possible for me to make the other side pay the court fee If I never paid it in the first place?

    I do not think it is fair that because of my personal/financial circumstances, that the other side gets away with not paying the court fees.

    The two applications would have cost £510.

    I've no idea.
    The question appears to be about recompense.
    If that's the case, then i assume an appropriate element of your claim, involved money (you from them) with the statutory phrase included, for adding interest at 8% etc.
    If that's not the position, and yours is a "defence" then, the court determines, that your financially limited, and thus affords a right to a free claim application, on merit.
    I don't think it's appropriate, to then suggest that the court fee, you have not funded, is "due" based upon your right of fee exemption.
