  • Default Notice of immobilisation sticker but no clamp?

    Hi,

    I am currently dealing with a bailiff (or not ) regarding council tax. I have had over 4000 arrears over the last 3 years, but I am pleased to say I am up to date or so I thought. It seems to be every August/September the council tax pass any arrears accounts to bailiffs.

    For the year 2016/2017 I was up to date for the first time in forever, however I have missed a few payments due to losing my job and having difficulty claiming benefits. Council tax then passed bill to bailiffs requesting the full years payment (up until March 17).

    Anyways, I am now back working. Tried to speak to council tax but they say nothing they can do as with the bailiffs, I have been here before. I have been awaiting them to pass back to council tax so that I can pay what I owe direct to them. The bailiff has been 3 times and not accessed my property.

    Last night he knocked my door again, I politely asked him to put correspondence through door, gave me the usual acquittal prison jargon blah blah. Anyways following this he knocked my neighbours door asking questions, he then proceeded to put a warning of immobilisation sticker on my car windscreen, which was parked on road not my driveway. Confused as no clamp, but a sticker stating a device attached to my car to prevent it being moved!! No device so I have moved it for now. I have not confirmed any ownership of a vehicle with bailiff and as no clamp I don't believe I have done anything wrong by moving it.

    Can anyone advise me on this as I can't seem to find anything online apart from it possibly being a new tactic, e.g., by calling and querying the sticker would give Barry bailiff enough to believe vehicle is yours.

    What do I do next, please help!!

    Move the vehicle now. several streets away.

    Then get back on to council as they are responsible for the actions of their employees (Bailiffs).

      Hi I have moved the vehicle, council are stating there is nothing they can do as the debt is with the bailiff. I've told them I am not refusing the debt I want to pay it, I am just under no legal obligation to deal with them.

      Will he be back for the car or not bother? I mean, the notice was put on there last night, I moved the vehicle this morning.

        Firstly, well done for managing to clear the huge arrears. It can't have been easy.

        With regards to your current situation, I don't believe that any advice that I give to you will be heeded as it seems from your post that you have no intention of paying the bailiff.

        In 2014, the regulations regarding bailiffs was completely overhauled and the effect of this is that, if a payment is made to the council whilst the debt is with the bailiff company, then the council are supposed to deduct from that payment the enforcement companies 'Compliance fee of £75. The balance of the payment should then be split on a 'pro rata' basis with approx 60% being allocated towards the council debt and 40% towards the bailiff fees.

        If the debt is returned back to the council then you are correct in that bailiff fees are removed. However, almost immediately that the debt is returned...the council will then send the Liability Order to their 2nd choice enforcement company.

        With regards to your vehicle, the sticker means very little. What the enforcement agent needs to do is to issue an official notice advising that he has taken the vehicle into control. It is very likely that he has not done so yet as he would first want to check whether the vehicle is registered to you.

        As thing stand at the moment, your vehicle is at risk of being seized.
