  • Please help, CCJ via Restons / Cabot/Halifax , requested a Tomlin Order

Newbie here, apologies if I am posting in the wrong section.

This has been ongoing for over a year now,

I got into a bit of bother after a divorce and ended up with a few debt problems.

To cut a really long story short I filled in paperwork for court claim and filed no defence, I however requested a Tomlin Order as my employment was dependant on not having CCJ `s or Criminal Record etc , yes my fault I know

So Restons were aware of my situation, I believe they do not have to go down the Tomlin route, however surely they have a duty to make sure I am not left out of work with dependants in the household ?

So I left it with them as they were going to speak to Cabot and let me know if my offer was acceptable.

Next thing I receive a default CCJ through the door.

I rang Restons and Cabot and I have got no where and having investigated my complaint Cabot do not think Restons have done any wrong despite the dates they quote not matching the emails I have for timeframe and shut off dates for repsonses.

    They had everything they requested.

I gave up and thought there was not much more I could do as I was getting no where so I decided to live with the CCJ.

They have now gone for a charging order which I have appealed and it has been transferred to my local court , I am awaiting a date.

What I would like to know as I don`t seem to be getting anywhere is , do I attend Court and hope the Judge will overturn the whole thing and return the case to the beginning , or do I put in an appeal against the CCJ now ?

Thank you for any advice in advance.

    Dan
