  • BW Legal PCN Charge Letter from 5 YEARS AGO!

    Hi,

    My wife received a letter from BW Legal regarding an alleged parking violation incident which happened nearly 5 years ago (see attached 01_Letter from BW Legal).
    We cannot remember if this actually happened as it was so long ago, and if it did who was driving. Also, this is the first we have heard about it and we have not ever received any PCN or other correspondence regarding this matter until the first letter attached. After doing a little bit of research we responded with a letter (see attached 02_Letter to BW Legal).
    They then responded again with another letter (see attached 03_Letter from BW Legal (Page 1) & 03_Letter from BW Legal (Page 2)).
    After this I have been doing further research and found this excellent Legal Beagles website. From information I have found on a similar post I have written a proposed email (see attached 04_Email to BW Legal).

    I was wondering,
    1. Do you think my proposed email is ok? Should I change anything?
    2. Do you think they have a case against us? I obviously do not and am quite annoyed by the whole thing.
    3. Any other guidance will be greatly appreciated.

        Hi,

        I have updated the proposed email (see attached rev2). I have added defence to the Elliott vs Loake case and added a section regarding them taking longer than 28 days to issue the PCN.

        Do you think this is ok to send? Any other thoughts / recommendations before I send?

            Civil Enforcement of Parking Contraventions (England) General Regulations 2007 - remove the whole paragraph as that is for council tickets, not private tickets.

            Predates November should say predates October.

              Thanks for the fast reply. I have amended the proposed email as advised (see attached rev3.).

              So do you think I should send now in response to their second letter to me (03_Letter from BW Legal (Page 1).jpg attached at top of thread), or should I wait until I get a letter of claim or court papers until I send?
