  • Secured loan NOT on title deeds?

    Hi all,

    In 2008 we entered into a secured loan with welcome finance for £10000. After making payments for a while we fell into financial problems due to loss of employment. After not hearing from the company and reading reports recently I'm unsure if they are still operating?

    Last month we recieved a letter from a debt agency requesting payments on the secured personal loan.

    We have recently accepted an offer for sale on the property and wondered if they have any rights to stop the sale? Little money will be left over but not enough to repay.

    I have checked out title deeds with the land register and they are not named? Only our mortage company. Do they have any legal rights?
