      It's not really been a long time.

      Your Defence was filed in December and you've said that the claim was stayed about four weeks ago.

      It's early days to be thinking of a strike out in my view, but I haven't seen the paperwork to know the full story.

      An application to strike out the claim (£255 court fee unless you're entitled to fee remission) will trigger a hearing.

      What kind of letter do you have in mind to send to the solicitors?

        Di, I don't have any letter in mind actually and yes its not very long yet but I just feel so frustrated (not even the right word to describe it&#128514 that they don't even send letters or say that they don't have any documents to go on. 😕

          I don't have a letter in mind for you to send either which is why I asked the question

          There is no need to send a letter.

          In fact sending a letter might only make things worse. Sometimes 'less is more' with litigation.

            Hi everyone, I know its been a while since I last visited here due to some serious personal matters... too long story to tell may I will start another forum😜

            Anyway, I have just received a copy of my so called signed agreement form..looking through it signature is quite not me?! and there was a pound payment as well,? I haven’t checked it properly yet though but they are demanding for a payment.. Please kindly advise? Thank You all...

              Hi Shann, Sorry to hear you've been dealing with some other stuff ... hope things are getting better for you.

              So, who has written to you, the Claimant ? and what do you mean about the signature ?

              Does the £1 payment look like it was your CCA request payment? ( what have they said about this payment ?)

              Have they mentioned the court claim in their communication at all ?

                Mortimer sent me the letter ..I am not sure about the £1 because I looked earlier and it was around 2009? which is really funny because I wasn’t even in the country? The signature looks like they just copy it ? I will check the letter again as soon as I get home ..

                          What are the dates on those payments/charges etc ? ( approx )

                          Ignoring that £1 when was the last payment before that ? When was the account defaulted ?

                          Were there any other terms along with that Capital One agreement sheet ? or just that ?
                          Was the notice of assignment from Capital One ( or from Lowell ) ?

                          What date ( year ) was the account opened ?

                          The letter doesn't mention applying to lift the stay and return to court so I wouldn't panic or rush about it - take your time a have a good look through the documents and decide whether to respond to them, and saying what. They've had this claim in play since November 2016 - blimey ( just having a read back through the thread - can't see date of account opening )

                            [MENTION=6]Amethyst[/MENTION] that’s the only agreement page they’ve sent together with the notice of assignment from capital one saying that they have sold the debt to Cabot, and a paper with the lists of charges (not a proper bill)
                            it was opened 2007, payment of £1 was Nov 2011..

                            and yes it was the same time as last year when they sent me the court letter .
