  • pcp handing the car back

hi I am at the point of voluntary termination of my car with fga capital.
I have followed the thread of previous problems and hope some of you can help?
I have emailed the finance company and also had a reply to confirm the car will be collected.
I have infact paid over 50% of the total cost stated in my agreement but the company are now saying that I owe them 440 for gap insurance and extras added to the agreement. I have checked my t and c and nothing says this is the case. I have emailed them back explaining I wont be signing any paperwork other then the car collection and that my notice of termination is enough.....where do I stand with this extra 440??

      Hello,

The gap insurance is normally tied up in the total amount payable and if that is the case then they have no right to the remainder of the amount as your liability for the total amount payable is 50%, nothing more. If they failed to set up a separate contract for the gap insurance, bigger fool FGA.

Well i cant actually find any seperate info on this as a seperate policy so i emailed them to say i wpnt be paying for this until the prove legally i have to otherwise i will contact the financial ombudsman. Since that email i have had no reply since 11am??

Also can i double check that when they collect the car i should take photos of it dated to ensure condition? They are asking me to pay for any repairs needed but this is incorrect yes?
I pick my new car up sat but they still havent told me when they will collect

Hi im after help if possible before 7pm as the manager from fga captial is ringing.to discuss what i owe.

Omg ....right on my agreement i can vt the car after i have paid half of the total amount payable which they state in the agreement is £7795.40 i have infacg paid a total of £8159.36 of direct debit.

They have emailed me to say i owe 333.96 ( was before the nov payment of 254.98) i agreed and sent an extra chq for 78.98.
I then got another email saying i owe an extra 440 for gap insurance? Then another more confusing one saying the added extras vap were not included on this figure and i now owe 552!

I have read my agreement again and again. It doesnt mention added extras on the termination rights clause just the figure of 7795.40? Even if i calculate with extras the total price its 16,576.31 so half tap is 8258.15. Therefore the difference is 98.79. So how can they wuote me all these figures are they trying to intimidate me

          Help!!!

Hello, first of all don't panic. If your agreement says you need to have paid £7795.40 and you have gone over that then you do not need to pay anymore. The GAP insurance is usually incorporated into the total amount payable so they can't claim that back separately and are trying to wing it.

I suggest you have a read of this http://www.legalbeagles.info/forums/...on-Your-rights

Re: pcp handing the car back

                    Hi,

I have just written to FGA Capital now FCA Automotive services to ask about a VT, I will have paid 50% of the agreed total in March. so will not be doing anything before then, but FCA have already outlined I have £187.73 Gap insurance I would need to settle. They also mentioned potential liabilities linked to normal wear and tear etc so will do everything to ensure I do not provide any opportunity for them to charge me.

What was the final outcome when you returned your car did they ever chase for additional money?

Second more general question my car is 2nd hand on a PCP, I had the 1st service done at an alfa garage but the 2nd service which was outside of the vehicle warranty period I had done at a independent garage but using official parts, at the time I had completely forgot about any requirements to always use a Alfa Garage. Will this come back to bite me now?

                    Thanks for your advice

                    WDK

Re: pcp handing the car back

Also looking for immediate advice on a V.T. Looking to return asap, no longer suitable for needs due to accessibility issues with a recent mobility impaired mother, vehicle is still in negative equity, fca automotive, I have checked with them via telephone call and have paid £6.00 over the agreement figure viable for a V.T.
Will be writing to them tomorrow with a view to returning after reading various threads on here. Do I inform them in a call or just proceed with a recorded delivery letter?
Can I request an email address to send my letter to, or will this not be acceptable?
                        Many thanks Sara
