  • I'm so stressed no idea where to post

    I'm shaking as I write been trying to sort a tax underpayment with my OH and HMRC for months now they have decided we have to pay it's nearly £6500 which we don't have we did query why it wasn't collected through paye now been hounded by there debt bank who insist we have to ring even though we are trying to agree in writing a repayment they are now threatening baliffs even though we are trying our best to sort it out does anyone know why it can't be collected through paye if they are hounding us to pay up asap

        Hi winner

        A fairly common problem, but if the reason for underpayment can be shown to be the fault of the taxman or the employer, you could try ESC A19. (Best to google it as there is loads of info).

          Yes tried that already they have refused to accept they are at fault it's 2014/2015 tax year he changed jobs so even more confusing he has stressed he thought the taxcoding was right but they won't accept that either it's the higher charge childbenefit and something to do with a company car benefit but why are they not clawing it back through PAYE we don't understand if we need time to pay

            Nasty bunch HMRC debt management as bad as the DWP.

            Who are you talking to Winner just one of the many desk jockeys?

            How did the overpayment arise, is your other half employed and on PAYE?

            Is HMRC using a debt collection agency to chase the alleged overpayment if so which one?

            I've dealt with a few of these DCA working for the HMRC and the DWP for people and I found that getting hold of the top manager in the debt management department gets a far better response.

            If it is a DCA chasing the debt they can huff and puff and make threats but they can't carry them out.
            Lets have some more detail on the matter and see what can be done.

            If you want PM me with the details perhaps we can come up with a " firm" response to them.

                    Is this tax issue anything to do with your thread started in March this year where you said your OH had completed a self assessment tax return resulting in a £9k bill?

                        Are you saying that the problem is you accept that he does actually owe HMRC £6,500 but the issue is the timescale for payment and the method (i.e. deductions through PAYE would help him spread the load)?

                        Depending on your OH's financial status you could ask the charity Tax Aid for advice on how to deal with this issue. A phone call to them may be your next step >

                          Sorry about the late reply 400 mile round trip every weekend to make sure my 81 year old mother has shopping and is OK stuck in Asda yesterday with a few thousand other people anyway answer to a few questions
                          yes it is related to tax post in February but rose to nearly £12000 due to payment on account figures added by HMRC no he hasn't admitted he owes the tax just backed into a corner I'm afraid and Tax aid can't help tried that already so will be posting later this morning some more info

                            I am sorry your arrears came as a surprise to you and I understand how worrying it can be to have to pay back tax that is unexpected .I am also very sorry to hear that you still feel very concerned about your tax affairs I very much want to settle matters for you
                            We try and collect as near as possible the correct tax through PAYE as code numbers are calculated using information available to us this is inevitably out of date as much of it is for the previous year if we do not know about a change in income or circumstances then arrears of tax can arise this is what happened in your case .
                            Our guidance notes are included on the notice of coding and they do ask you to keep us informed of any changes in your income or changes which will affect your tax position
                            All tax codes are based on information we hold at the time they are prepared at the end of the year we review everybody's tax position to make sure they have paid the correct amount of tax
                            In your case we reviewed the position regarding your underpaid tax in 2014/2015 several times we wrote to you and explained we could not waiver the collection of tax because ESCA19 were not met
                            I have reviewed also and can confirm I agree with the decision
                            I suggest you contact our Debt Management and Banking sections to set up a repayment
                            If you do not then additional penalties may be charged

                            It goes on to say it can be referee to tier 2 if we are not happy with the findings
                            IT was at this point we contacted DMB and the can of worms was opened
                            Unfortunately I can not find the last letter from DMB from the other day and my upload was illegible

                              Apparently
                              He posted it back to them with a short note asking for everything in writing hells bells so sorry it briefly outlined they had tried to call us funny no numbers used as it can only be done over the phone but after trawling through various advice sites it clearly states to put everything in writing
                              It then went on to say about collecting goods from our home ,
                              I still can't see why it not done through paye from what I gather it can be done over more than 12 months
