    Something like this in your defence.

    The defendant is unable to reconcile the amount claimed with any account he may have had with the original creditor.

    The claimant is put to strict proof as to how the amount claimed has been calculated.

    If Lowell Solicitors Ltd., has had a hand in preparing the claim it may well be totally wrong going by their performance in many claims I've seen recently.

          On 18th October 2016 I received the Claim Form in this case issued by you out of the County Court business centre, Northampton.

          I confirm having returned my acknowledgement of service to the court in which I indicate my intention to contest all of your claim.

          Please treat this letter as my request made under CPR 31.14 for the disclosure and the production of a verified and legible copy of [each of the following / the] document(s) mentioned in your Particulars of Claim:

          1 the agreement. You will appreciate that in an ordinary case and by reason of the provisions of CPR PD 16 para 7.3, where a claim is based upon a written agreement, a copy of the contract or documents constituting the agreement should be attached to or served with the particulars of claim and the original(s) should be available at the hearing. Further, that any general conditions incorporated in the contract should also be attached.

          1.The agreement, including the specific Terms at the point the alleged Agreement was made and any subsequent changes.                 Part 18 is for asking questions / more information as opposed to document copies. CPR 31.14 is for asking for copies of documents mentioned in the statement of case. Ie what documents are mentioned in the particulars of claim?

                How much is the claim against you for approx ? ( is it actually for £186 ? or 2705.50 ?)

                Not sure what this is - is it meant to refer solely to the statutory interest on the claim?

                    Your CPR 31.14 request therefore can request a copy of the 'terms', the 'account agreement' and the 'notice of assignment'.

                    If you want to send a Part 18 you could use that to ask for a statement of the account and details of how the amount has been arrived at.


                    Those CAG letters are very wordy aren't they !
