    Re: Sainsburys Credit Card

Just a letter from Shoosmiths stating they had asked AG to check that they had complied with the CCA request. That was sent to me 7th March.

A copy agreement was sent and a set of terms and a history of the account, statements etc. A nice bundle about 30mm thick!

I will check these this evening Di.

So no deadline to comply with or else legal proceedings would be issued?

Nothing new on that score. This came direct from Sainsburys though. Mc

          Re: Sainsburys Credit Card

Just to clarify there is no letter with a deadline at the moment. I have had a look through the documents and it is made up mainly of statements and internal computer records. There is a copy agreement and as far as I can see it is identical to the one posted earlier. There is TWO bundles of terms, one being 9 pages long and the other 7 pages long. What is conspicuous is that there is no Default Notice within the bundle and I have checked three time for it. I have a copy of documents issued under a SARS request in December 2009 and there IS a default notice within those and it is dated 12th December 2009 requiring payment of £368.06 before 14th January 2010. Needless to say that was not paid so the account would have defaulted then. How critical is the fact Sainsburys appear to have lost their copy of the DN? Thanks for all you help again. Mc

The OP last heard from Shoosmiths in February when they sent a non threatening letter.

There's no reference on the thread to anything since then (no LBA) except the OP received a SAR response with documents from the original creditor which will be useful if Arrow does decide to issue proceedings in the future.

Thanks Di. Is there any significance in the default notice not being in the documents received? By the way, I don't like to trouble people by sending them personal messages but I did not know how to draw attention to the thread for advice. Any advice on the best way to do this would also be appreciated. Thank you. Mc

                  Re: Sainsburys Credit Card

You need to check the Transaction Log to see if/when the DN was issued because the current owner of the debt may reconstitute one if needed. If you know the truth (date issued and amount in arrears at the time and the remedy date) then you'll be able to tell if their recon is 'honest and accurate'.

I did get your PM but I didn't reply because I peeped at you thread and could see no new updates. I try to avoid PM advice so if you need to contact me use my email which is in my signature at the bottom of each post I make.

I'm also subscribed to any thread I've ever posted on (around 800 so far!) which means I get an email alert when a new post is added.

I hope this helps to explain my silence - I assure you I wasn't ignoring you

Haha! Thanks Di! I didn't think I was being ignored, just thought my thread was in the wrong place or something! Thanks a lot. I have the original DN off a few years ago and will check it as and when. Mc
