    No very clear, is it?
    Can you confirm that, at the very bottom of the first pdf, it states Nov 05/01?

        No signed copy of agreement.

          Weird one line statement showing a payment in 2009. how much was it for stated?? more so did you make the payment??? something may not be right here??

            Sorry, I didn't even notice the date. So not the correct t&c's?
            The statement says minimum payment due £542 on 11/8/09 then under transactions it says
            9/6/09 min payment 85.00
            1/7/09 part payment received 29.00
            9/7/09 min payment 85.00
            141.00 net arrears 458.00 total arrears
            29.00 seems a strange amount unless I had an arrangement with them. I honestly don't remember. I will post it up properly.

              They've given me 14 days to contact them (although the letter was dated 26/9 and I only got it sat) or they may refer me to Howard Cohen who may take legal action.

              No signed agreement, wrong T&C's (so non-compliant with your CCA request).
              Was 09/07/09 your last payment? (You mention something about DCAs & token payments)

                I've been paying £1-5 on and off to different dca's. Think the last one was about 18 months ago.

                  You should have received a signed up-to-date statement (CCA request) reflecting all the payments made.
                  As things stand the assignee (current 'owner' of the debt.....Hoist Portfolio?) cannot enforce this, but as it is only at the 'may take legal action' stage, informing them now will give them all the time in the world (well, 6 years or thereabouts from the last payment) to correct their mistakes.

                      That would have to be your decision, G.
                      Personally I would not class their communication as a 'Letter before Action', which is a step they ought to take before embarking on the litigation route. It's part of the Civil Procedures Pre-Action Protocol.
                      But there's always a risk in these things, & Debt Purchasers do seem to play fast & loose with the rules.
                      All I can really say is that I have ignored this type of letter & nothing untoward has happened.
                      But it is a gamble.......

                          Hi, back again but so much has changed. I lost my husband suddenly in January. As you can appreciate I'm lost and devastated.
                          I had a letter from Howard Cohen this morning saying unless I pay or make an arrangement they will take it to court.
                          This is the first contact since I last posted here. I'm thinking just make an arrangement to pay a certain amount a month as I'm so tired of fighting. If I tell them what's happened what would be the likelihood of court action? It's just me and my children now and I don't have the strength of brain capacity to deal with this.
