    Dear All
    Advise greatly appreciated. I received a letter from Choren & Co, advising I contact Robinson Way and arrange payment within 10 days from 27th Sep or they will commence with legal action. There's been no acknowledgement since the last payment paid on 1st March 2010. They are claiming that SB clock starts when the default is registered which appears to be Nov 2010. They suggested that i google the BMW case. I contacted NDH who suggested I send a statute barred letter, i'm awaiting a response.



    Would someone be kind enough to cast an eye over the payment history which I have, I took it from CRA and it shows the account was marked 0 three months before it showed a default. Should I share, do i just post the docs to this thread and await a response, or post to another thread. Please could someone kindly advise. kindest regards.

    The BMW - v - Hart Appeal Court judgement was in regard to an Hire Purchase Agreement.


    Please give us some more details on this alleged debt.

    Original Creditor?
    Amount of debt?

      Hello Nem Thanks for you quick response,
      Barclaycard. Last payment/Contact March 2010 the ballance then was 6.5K Default date on CRF Nov 2010 with ballance 7.8K sold to Hoist Dec 2010

        The default date on the CRA file is not the crucial date.
        If B/card terminated your account some months before Nov 2010, that will be the relevant date for SB even going by BMW-v-Hart.
        Hoist & their monkeys are cutting this one fine!
