Another friend has two separate accounts that were passed to Jacobs ... they paid the council direct on 08/07/16 against my advice . Two payments (one for each LO). After asking Jacobs (who carried on calling) for a breakdown of their fees it looks like Jacobs are treating each LO separately instead of collecting them together ... meaning they have charged £235 twice! I was under the impression that this was not allowed :noidea: (they've even gone as far as sending two texts, one for each account , within minutes of each other)

Again, any advice appreciated Milo Snoopy1948 bizzybob ploddertom xx

Re: Jacobs

The chances are that they can charge 2 separate lots of £235, looking at the time scale between the 2 accounts. If he visited in 2014, he can charge the fee. If he visited again in 2016, he can charge the fee again. The "joint" fee only applies if it is possible to visit at the same time for two or more debts.

Your friend needs to check when these visits wee made for each account. If they have enforced them together, she has an argument.

Re: Jacobs

Then only 1 x £235 may be charged. You have only posted the breakdown for one of the accounts.

Re: Jacobs

I see it as her owing £55 on the first debt and £219.11 on the second debt. The £235 fee should come off the debt of £156.

She should write to Jacobs and copy in the council of this asap, preferably by email.

Obviously, you know the drill with cars, locked doors etc.

I've been and sat with her twice now when the bailiff 'threatened' to turn up and remove goods  both times they didn't bother!

There's no car near the house (her bf has one on finance tho' that gets left in the carpark at work ... that should be exempt shouldn't it?) and nothing that they can touch outside. The door is always locked too

latest text messages on this one ... no reply to the complaint about 2x£235 being charged as yet and they are still making out that they are collecting each separately (it looks like they are ignoring anything that isn't a payment )
Indebt ... am I right in saying that they cannot force entry without a warrant?

They cannot force entry-They can take anything outside though.

I would be inclined to txt back and say something along the lines of "complaint now gone in to council, as to why 2 x enforcement fees have been added. Please do not return until complaint is resolved. Permission to enter is refused and no vehicle outside"

Re: Jacobs

Having looked at what you have posted it does seem as if these were 2 separate debts put out at different times thus enabling them to charge separate fees for both.

I'd probably agree if they weren't collecting both at the same time

Re: Jacobs

I agree with Ploddertom here that the fees are correct.

The first account for £452 looks to have been sent to Jacobs in December 2015 and a Complaince fee of £75 applied that same month. A personal visit appears to have been made on March 22nd 2016 and accordingly, an enforcement fee of £235 had been applied. At the time of this visit, there were no other accounts on the system.

In May 2016 another account was passed to Jacobs and they applied a complaince fee of £75. A personal visit was made in August 2016 and accordingly, an enforcement fee of £235 was properly applied.

Most importantly, at the visit in August, the enforcement agent attempted to obtain payment for BOTH cases. This is good practice but it must be made clear, that he was only charging the enforcement fee for the debt passed to Jacobs in May 2016.

Unless the enforcement agent is able to take control of any goods, no further fees can be applied.

The debtor claims that only one visit has taken place.

A complaint is in. Let's see what jacobs come back with before getting too far ahead of ourselves.
