  • Lowell Solicitors - Letter of Claim

    Hi all,

    Just for info my previous thread was http://legalbeagles.info/forums/show...624#post680624

    I've now sent the CCA letter to Lowell and they received it and I've got the Royal Mail proof for that.

    The letter of Claim says they'll start proceedings on 10/10/16 so I don't know if the CCA stops them or they'll continue on with a claim.

    With regards to the debt being statute barred with the last payment being made 22nd June 2010.

    Do I not need to be sending them the statute barred letter in the hope that they won't bring on a court case or can I just add statute barred in as my defence for the claim when they issue it?

    Could anyone answer please my question as I feel I'm running out of time if it's best to send the Statute barred letter before the 10th October.

      In my opinion send a SB letter but I'll pretty much guarantee they will issue proceedings against you any way but it's not the end of the world if they do, they try their look and send many a letter claiming they have you backed into a corner on the hope you back down and pay...
