  • Gladstones Solicitors/IPC/Link Parking

I have an ongoing parking "charge" from Link Parking which has now moved to their solicitors - Gladstones.

In May I was parking in my son's car park for a short time - no more than 30 minutes - and came down to find a "ticket" demanding £100 (£60 if paid with 14 days) on my windscreen. I immediately realised that my parking permit was not visible as it had slipped down the dashboard. Assuming (common sense!) that the ticket would be cancelled when Link Parking were informed of this, I contacted them "appealing" the ticket on these grounds.

My FIRST mistake: I admitted I had been driving. I know... too honest to play with these cowboys.

They immediately dismissed the appeal. I then received a Letter before Claim from Gladstones demanding £150!

I have been writing back and forth to them and to Link and eventually got the Secretary of the Board of Management of the flats to write to Link explaining that I was the mother of a resident. It was rather a meanly-mouthed letter to be blunt culminating in:
Clearly, we cannot arbitrate in this matter. This letter is simply to point out that **** *** (car reg) was parked here by a close relative of one of the residents at ********** (address).

    Yours faithfully
The situation now is that I have sent Gladstones, copying in Link, several emails and letters asking them for more information re their grounds. Very little has come back to me.

I am expecting court papers before long.

My son is working abroad but when he gets back next week I hope to be able to see the lease that came with his flat rental. The secretary of the Management Board did say that there would have been nothing in that lease re parking.

I also notice online that Gladstones & the IPC used by Link are run by the same people. This seems VERY incestuous.

I have emailed my MP re this matter and am presently compiling a report to SRA.

I would appreciate any feedback as to how to progress with this business. It has taken far too much of my time already to research and to respond to their unfair and bullying "charge".

Many thanks to anyone who can help, particularly if you have fought Link Parking/Gladstones. It has been suggested to me that it is a matter of contract law, or rather no contract in my case.

Much stands on the contents of the lease and the signs. It does sound like permit holders only though.

I possess a permit, but it wasn't on view.

Got that, that's how i came to that conclusion.

Not much i can say or do unless they file a claim, however that case should give you some ideas.

Yes, just read that case. Thank you. Might be useful. I'm hoping that there is no mention of Parking "charges" etc in my son's lease. And then it may be the case that no contract exists, despite the three notices in the car park. We'll see when he returns home.

                Re: Gladstones Solicitors/IPC/Link Parking

Nothing whatsoever about parking or the car park or a Parking Company in the tenancy agreement. I have to reply to the Claim Form from Northampton court in the next day or two. Could I just depend on this >>> no contract? Or do I have to compile screeds of reasons and several case links to prove them? Other forums seem to suggest this. Time is short and life is busy.

                  Re: Gladstones Solicitors/IPC/Link Parking

The claim is probably scant in detail so a huge defence isn't required. Th contract issue should win on it's own but not every judge sees it the way most do.

Post up a sanitised version of the claim form and the sign if you can.

Hi M1. I can only see how to upload from a url not from my hard drive. Also, what do you mean by "post up a sanitised version of the claim form"? It's empty so far. Haven't completed it yet. It's just the usual form from Northampton that everyone gets, I think.

See the link in my signature.

The claim form might not contain much but it won't be empty.

I still can't upload pictures from my computer. I'm only getting one option - selecting a url. Can't upload from my desktop, seemingly, even in advanced mode. Will I send it to you by email? Oh hang on... I think it's worked.
