  • Littlewoods, Arrow and default!

    Evening all,

    Looking for some help if you can oblige?

    Long story short... DMP in 2008. Small payments made to Littlewoods. They sell it on to Arrow in 2012. Arrow defualt me in 2015 for £90.

    According to CRA littlewoods never defaulted me. Complaint sent to Littlewoods six weeks ago (recorded delivery)- request to backdate defualt - absolutely no response ... nothing at all.

    SAR arrow. They say they sent DOA and default notice but did not include copies.

    Is this allowed? What next??

        Good morning.

        Littlewoods have done this kind of trick before no default for an unreasonable and unfair length of time and then selling on the debt giving the purchaser an unfair advantage in relation to the Limitation Act 1980 provisions.

        When did payments cease completely through the DMP?

        It is possible to challenge these unfair late defaults starting with a Formal Complaint to the Data Controller at Littlewoods copied to the Data Controller at AG stating that the default is unfair and you want the default put back to the date of the actual default.

        If there is no positive result or the letter (s) are ignored then lodge a complaint with the Information Commissioners Office.

        If you need help with letters please let me know.

            Thank you so much. I sent a complaint requesting a back date on 17th August by recorded delivery. I have heard nothing from them. I thought I would wait the 8 weeks and then complain to the ICO. Am I correct in thinking that this is an issue with Littlewoods as the original creditor and not Arrow as the debt purchaser? Can I and should I also complain about Arrow in the same complaint or address it separately? I have read that the selling of a Debt constitutes a break down in the relationship and this entails a default so I'm expecting at the very worst for this to be backdated to 2012.

            I took over my own dmp in 2014 as I felt that the costs outweighed the benefits and have been paying directly since. I currently have the account on hold until this matter is addressed.

              Just wanted to say thanks.... complaint lodged with FOS and ICO and FOS confirmed today that they will be requesting that this default is removed from my credit file. I shall keep you updated as to the outcome. Many thanks for your advice

                Good morning,

                You are correct, Littlewoods generated the original CRA records, I suggest that the date of the very last payment to Littlewoods + 2 months would create the " default " situation.

                By all means send a copy to Arrow if you want to.

                After the 56 days expires without any response then yes a complaint to the ICO is the next action.
