  • Civil Enforcement Limited Parking violation

    On 12/8/16 my wife's car was parked in a local car park controlled by ANPR managed by Civil Enforcement Limited. The driver entered the vehicle registration number checked it and received a ticket for the allocated parking.
    On 9/8/16 my wife received a PCN stating that the "payment had not been made in accordance with terms displayed on the signage".
    My wife e-mailed Civil Enforcement immediately providing a copy of the actual parking ticket which had been retained, although this does not state the registration number of the car but does provide an entry and exit time which coincides with times issued on the parking ticket.
    CEL responded advising that the appeal had been unsuccessful confirming that the registration number had been incorrectly entered.
    Although they extended the expiry time by which it can be paid at the reduced rate she is loathed to pay even the reduced rate as we have proof of payment even though they state it was not correct.
    What are our chances of succeeding in an appeal to POPLA

    Could you check the dates you gave please. if the ticket was 12/8 and PCN received 9/9 then they have failed to follow POFA to hold the keeper liable.

    Looks like there was an equipment failure in that the ticket machine failed to register or print the registration number.

    What did it say on the signs about having to enter the registration number?

        The issue date as recorded on the PCN is 8th September the violation date was 12th August. The pay machines clearly stated that the registration number was to be inserted which it was. However, it does not appear on the parking ticket issued so there is no way of establishing you did in fact put the correct number in. If the ticket had shown the incorrect registration number I would simply have bought another ticket it was only 50p.

          Ok so there was more than 14 days between the alleged "offence" and the receipt of the PCN. With no windscreen ticket then the keeper of the car cannot be held liable under POFA, only the driver. Do they know who the driver was, ie was it given to them when your wife appealed? Do the signs state that failure to enter the VRN is liable to a PCN? Probably not but looking at machine failure here.
