    The blockages in the car park certainly help us.

    Your appeal will be an edited version of Furrycritterpopla.rtf to reflect the blockages, when the time comes.

      right i have also been doing some research and have found out that ParkingEye do not have advertisement consent for any signs at the car park

      i am not sure if these signs are less than 0.3m sq

      i think this should kill the PCN ?

              Hi all,

              I seem to have found a fatal flaw in the ParkingEye Notice to Owner (fatal to ParkingEye that is). I received what I believe is one of their standard Parking Charge Notices dated 13th August 2016 concerning an incident on the 9th of August. I was not the driver at the time and I am able to prove this easily. I waited until the 14 days that a Notice to Owner must be served within had elapsed and then wrote back to them explaining why I believed they had not issued a valid Notice to Owner. They sent a holding letter saying they were investigating and then today I returned from holiday to find a letter dated the 11th October from them saying they had cancelled the charge.

              After reading many threads and seeing how tenacious they are I can only assume they agree with me that they did not issue a valid Notice to Owner. The implications for ParkingEye appear great as I have no reason to believe my Notice was any different to others they have been issuing. I assume anyone else who has received one could challenge on the same grounds, anyone who has already paid could claim a refund on the basis they have been mislead by ParkingEye into believing they had an obligation to pay when in fact they didn’t and as for enforcement by via the County Court, they appear to have been making false claims which I suspect is quite serious.

              I am very keen to help as many people as possible with this information; I had some success with Bury Council a number of years ago (google “Macarthur VS Bury Council”) but don’t feel the information helped as many people as it could have helped. I am very keen to hear if anyone on here has any ideas how to get the maximum impact.
              I’m happy to reveal the flaw in the Notice to Owner but not in a public forum just yet, please get in touch if you have any ideas on how to proceed.

                  I can easily make a template for you but before I do that I would like some feedback from the more knowledgeable on here. In my letter to ParkingEye, I made it absolutlely clear the only way they were going to get any money from me was through the courts and that I would defend and in my opinion I would win. It maybe they decided I wasnt worth chaseing and gave up, or they realised they had a seriously flawed Notice to Owner. I think its the latter but I may be wrong, in which case my template will be no use to you.

                    I dont know if this is any help but I just took a look at your Parking Charge Notice. Its difficut to tell but it doesn't look like you could identify the location of the car in the pictures. In my PCN it's the same, they could have been taken on any road and it doesn't even look like a car park. If I hadn't found the other flaw I would have challenged on the grounds they had not provided any evidence of the vehicle being parked.

                    The signage also looks poor, it does not state that they will persue the keeper for the charge if the driver is not identified.

                    It also says you are giving them permission to caontact DVLA for the Keeper details, but if you are just the driver and not the keeper how could you give permission on behalf of the keeper? I'm dont think they need permission but if they dont, why put it on the sign, it's all very poor.

                      Right i have received my Rejection Letter and POPLA Code, i am looking to sort this out this weekend, any help would be appreciated
                      im surprised they sent me a FAQ, i thought it is pretty strange it refers to ParkingEye vs Beavis case. maybe just trying to scare us
