  • CCJ Rent Arrears Expires Tomorrow - Help Please

    Good evening.

    I was issued with a CCJ for rent arrears back in 2010. The CCJ expires tomorrow, 17th September 2016 but I have today received a letter from my old landlord which reads as follows:

    "Outstanding debt for * T******* D****, 2008-2009

    I am writing concerning your outstanding debt to me. You may recall that on 17 September 2010, L********** County Court ordered you to pay me £4465.14.

    Having had no contact from you since the judgement, I did write to you in 2013 (I have not received any letters from him)to discuss repayment but received no response.

    It is my intention, if necessary, to secure enforcement through the courts. Before I go down this route, however, I want to give the opportunity to discuss the matter with me. If you are interested in discussing the matter first, please respond at your earliest convenience.

    Yours sincerely"

    I got into rent arrears when I got full custody of my then 9 year old daughter so had to give up my job. I then had to go the benefit office and claim benefits including housing benefit, but the amount didn't cover my monthly rent, this is where I began to fall into debt and eventually the landlord gave me an order to leave his property, which I did.

    Any help or advice would be appreciated.

    Without seeing the Judgment it's hard to comment.

    So may I ask what you mean by "the CCJ expires tomorrow"? CCJs don't become statute barred if that's what you mean since you say the CCJ was in 2010.

    Can you clarify if you've made any payments since the CCJ in 2010?

    If the Claimant (your ex Landlord) wishes to seek enforcement of this CCJ he may be in some difficulty due to the time lapse (6 years) if he's done nothing about it since 2010 or even 2013.

      Hello Di,

      Thank for the prompt response. The CCJ comes off my credit report tomorrow thats what I meant, I should have been more clearer sorry.

      I haven't made any payments because I haven't financially been able to afford to. Neither have I had any correspondence with him.
