    Re: Lowell Claim help please

    Which court did she ring?

Northampton (NCCBC) would stop communicating with her after the DQ stage when the case would be transferred to her local county court who should have written to her with a Notice of Hearing including Directions stating when the hearing was listed for (and how long it would be) and when she should file her Witness Statement etc.

Did she not receive the Order dated 22nd December 2016 (it may have got lost in the Christmas post)?

If she didn't receive the Order she may be able to make an application to set aside the CCJ.

Even if she didn't attend the hearing she did file a Defence which the DJ should have considered.

Try to establish what has gone wrong to see if there's a way to put it right.

She hasn't received anything at all until this form of Judgement arrived. I could maybe understand one letter going missing but several?

She rang the number on the bottom of the judgement form 03001235577 and was told that it was just a call handling centre and that someone would call her back. Someone did call her back but on a withheld number and she was too flustered to ask for a name or where they were calling from. They started running through everything and confirming what letters had been sent out but the after they spoke about the N180 being received by the court thy cut her off.

How is she supposed to find out what went wrong? Who is she supposed to call? The judgement came from Nuneaton court but there's no mention of whre the order on 22/12/16 came from.

If the Judgment came from Nuneaton County Court then she should ring them direct assuming that's her local county court.

After filing the DQ at NCCBC she should have received a Notice of Transfer informing her that the case had been transferred to Nuneaton.

She did ring them, that number is the one listed for Nuneaton CC. When they answered they said they couldn't help as it was just a call handling centre!

Can you run through what else she should have received from the court please? They must have made an almighty cock up to have not sent her anything until the judgement letter.

You should have received a letter like this from the court the case was transferred to after filing the N180.
                http://s194.photobucket.com/user/ste...06.26.jpg.html

Did you keep a copy of the N180 you submitted ? I'm wondering if an address was entered incorrectly on it and future letters went to the claimant or their solicitors in error? You should have received a copy of the claimants completed N180 as well, but tbh they don't always bother.

Really the only way to figure out what happened is to speak to Nuneaton as that's where the Judgment Order has come from. You need a copy of the 22nd Dec Order.

Also if the 22nd Order was for a hearing date and witness statements, it would apply to the other side too, and they should have sent theirs to you as well as the court - that not happening too is concerning...

The Judgment you received, was that directly from the court or sent by the claimant?

Have you had other post okay?

                  Re: Lowell Claim help please

No we didn't keep a copy but I triple checked everything that was sent so there's no way there was any errors in the address.

                  - - - Updated - - -

I'm trying to ascertain how many letters have mysteriously not been sent out. Clearly the court have made a massive error and are at fault here.

What else should she have received after the letter of transfer?

The judgement came from Nuneaton court, it had their post mark on the envelope.

No other problems with the post at all.

When she rang the court and someone rang her back they checked that they had her correct address on their system.

                      Re: Lowell Claim help please

You should have received a notice of the transfer, a copy of the claimants directions questionnaire, a notice of hearing (possibly combined with the order for witness statements or maybe a separate order from 22nd Dec), a copy of the claimants witness statement and documents.... that's if it was going to hearing - if not and the claimant applied to strike out the defence you should have received a copy of the application, any order from the court ( maybe to submit documents/further/amended defence) etc.... but definitely something after the DQ was filed. Any way you can go into the court and have a word with the desk clerk ? They should have records of what was sent to you and a copy of this order you were supposed to comply with dated 22nd Dec. While there you can pick up the form to set aside the judgment (N244 application). Seems like its ruddy impossible to get info off them over the phone.

Otherwise you could speak to the claimant's solicitors and ask them for a copy of the 22nd Dec order?

That's a lot of letters to go "missing" in the post! Something's not right here.

It's not far so I think paying the court a visit seems like the best option.
