  • Rossendales £235 charge for a debt of £5.46

Hi all. At the end of last year, I made 2 payment arrangements with Rossendales regarding last year's and the previous year's outstanding council tax - one for £49 per month (total debt £349.46) and one for £21 (£211.17 total debt) per month. I had letters to state that these amounts would be debited every 31 days until the account is paid in full..
Today I had a letter through my door from a Rossendales enforcement agent, saying they would take control of goods to enforce the debt outstanding of £240.46. Considering i had not missed any payments, and not understanding why this debt was so large, I rang the agent who informed me that there was an outstanding amount of £5.46 on the account I had been paying £49 per month on.and the remaining £235 was debt collection fees for her visit today.
I explained that all payments had been taken by Rossendales, and they were still (up to this month) taking the £21 for the separate debt. She checked the account, and it stated the last payment of £49 had been taken on 20th May this year, leaving a balance of £5.46, and then the payment plan had been cancelled on the 23rd May. I did not cancel the payment plan, which can only mean that Rossendales did. The payments were not made by direct debit, but by recurring card authority. I assumed that this was flexible, unlike direct debit, but Rossendales are saying they are not able to change the amount, hence the final fiver outstanding.
I'm furious. Why should I have to pay £235 when they had stated (in writing) that the monthly payments would be taken until the amount was paid in full.
Where do I stand with regard to having to pay the enforcement agent fee?

Rogues. How do they get away with it? I'm not experienced with such matters but am sure someone will be along to help.

Looks like they have engineered a default to ground the enforcement fee, I would contact our local councuillor, and the elected leader to appraise them of how trheir appointed agents are attempting to bend the rules to gain an Enforcement Fee. Presumably the arrangement was set up at Compliance Stage? This would mean Dossers could only apply the £75 Compliance Fee.

Firstly, well done for managing to clear your account.

If you have no objections, I am going to send a message to one of the moderators to ask whether they have any objections to me contacting you via private message.

Your account (and complaint) needs to be reviewed by a senior staff member at Rossendales. I will provide details for you.

Rossendales have many thousands of live accounts at any one time, and I would hope that this mistake can be quickly resolved and the visit fee removed.

Hope Rossers see sense and remove the fee, bailiffs are good at making "mistakes" for even a penny if there are fees to be garnered.

I would be surprised if they did not remove the fee (of £235). Unfortunately, the OP has not responded to my PM.
