      if they issued on behalf of the claimant then they are the claimants representative (solicitor)! ?

      you could send letter Recorded Delivery notifying the correct address and request confirmation of receipt to your letter?

        I'd put the new address details in writing to them in your response to their letter and also quote the definition of creditor under s.189 of the CCA back to them - and give them the £1 back.

          “creditor ” means the person providing credit under a consumer credit agreement or the person to whom his rights and duties under the agreement have passed by assignment or operation of law, and in relation to a prospective consumer credit agreement, includes the prospective creditor;
          Section 189 Consumer Credit Act 1974

          They have claimed that the debt has been assigned to them, therefore they are the creditor as envisaged by the act.

          Do you want to draft a letter and pop it on here and we can make sure it's okay before sending. Polite, short, factual and reasonable - and always bear in mind a Judge will read it.

            I had EXACTLY same letter 2 days ago - and wonder what games they trying to play.
            yet another batch type letter- with mine it was already over 20 days since the CCA was applied for- so out of time

            I am awaiting directions from DDJ for an Application and Order i put in - so may not do anything with this- could just use against them if ever need to goto court.

            Seems ARROW and Restons really firing out these court claims with ultra poor paperwork and a pile of numpties in their offices!!

              Morning all

              I have spoken to the court and my case was stayed 2 days ago. Can i at this point ask for it to be thrown out on the grounds that it was not served at the correct address?

              If not how long does it stay for?

                A stay is indefinite the claimant must pay a fee to lift the stay before they can go forward.
                The claim having been Stayed only a couple of days ago I suspect an application to strike out would be resisted by Shoosmiths as unreasonable.
