      Write to the court and confirm the defendant has failed to comply with the Order as per Judge Traynor. they have not provided all of the documents as requested in their Particulars of claim, namely the agreement or terms and conditions at the time, or the statement of account as they say will be forwarded on receipt. It is not acceptable to just request the documents now and forward at a later date, they haven't applied for relief from sanctions to extend that time and so the claim should be struck out in my eyes.

      A copy of the letter to the court should be sent to Lowell too, as their time was up on 5 December and their letter wasn't even written until 6 December which is still non-compliant.

      As for the Assignment letter, have you done a SAR request to Vodafone? If not it might be worth doing to see whether or not that NOA was sent a month later. Maybe I'm being pedantic but that is simply a letter which is on plain paper, does not have any of the logos or information as required by law under the Names and Trading Disclosures Regulations 2015 (the all previous law) which says that any business stationary must contain things like logos, registered office addess etc.

      I appreciate this may be a copy but a copy of the letter should show this information, hence the SAR request to verify the date. If the date of the assignment on the NOA is wrong, then the NOA is defective and invalid.

        just got a letter from lowells solicitors today, for a vodafone debt, notice of discontinuance because lowells couldnt produce the evidence requested by the judge in a court order, invoices terms and conditions and a full breakdown sums claims.

          received a letter today froms lowells solicitor about a vodafone bill, notice of discontinuance , lowells could not produce imformation requested by the judge , because they tell lies in court and use fraudulent paper work,

                just received a letter today from lowells solicitors NOTICE OF DISCONTINUANCE, over a vodafone debt , they could not provide the evidence requested as ordered by the judge, which states,
                for the claimant to explain a full breakdown of sums claims and to provide copies of invoices from 29 september 2011 to 27 february 2012.

                      lowells trick is to confuse you, hoping that you mess up offering you mediation, threatening with ccj , submitting paper work late ,and producing witness statements two days prior to a case such as mine, when in court they go straight in for the kill asking the judge to award them the claim, based on there witness statement, when questioned about the debt they had no paperwork to back it up , terms and conditions, invoices, and any breakdown of claims and sums , check all your paperwork, i had two letters exactly the same from lowells apparently from vodafone , one dated 9th and the other 10th, pointed that out to courts in my witness statement, that they are fradulantly altering paperwork to suit themselves, lowells buissness structure is based on buying bulk debts , they want you to roll over and pay what they want you to pay and not defend there claim,

                        Isn't that the modud operandi of all the bulk debt purchasers, they rely on a significant number of default judgements!

                          HI R0b, is there any specific template I should use for this letter or do you have a set format you use for them? Never wrote a letter to the court so bit unsure and do not want to get this wrong.

                            There's no specific template or requirement but simply writing to the court and enclosing the Order by the judge. Then explain that the Defendant has failed to provide the documents required by the date on the Order and therefore you ask that the claim is struck out on that basis.

                            It would be up to them to then make an application to reinstate the claim.

                              After sending my letter I got a response from the court saying they extended the time for evidence to 7 day before the hearing.

                              I then received this letter from Lowell Solicitors today.. assuming this is good?!
