      i replied to the courts on 22nd Sep, i've had an acknowledgement from the courts, but nothing else has happened.

      what are the next steps?

        I got a letter from the courts that they intend to continue the claim, and they did not include any defence information?

          BW Legal have the option of a "reply to defence" but i've not seen them take that option. (basically your defence is shite and here is why).

          So the next you will hear is probably a directions questionnaire to set the court location, allocate to small claims etc. Then you'll get a date and instructions for filing evidence (witness statement photos etc as required)

            yes i have the questionnaire to fill in and return to them, I will get this done today.

            just to clarify, do you mean bw legal think the defence is shite? which means i will end up going to court?

                Hello Mystery1, me again!!

                ok so i got the letter from the court about the small claims track etc, I don't understand it at all and I am unsure of what needs doing? can you look at it for me?

                      Gotcha.

                      So we need to send anything we intend to use in evidence to the court and BW Legal by January the 10th and the trials are in March.

                      We start with the intent to create 3 identical bundles (although 1 for your own use can be marked with highlights etc) http://www.johnantell.co.uk/how-to-c...t-trial-bundle

                      You'll need a witness statement https://www.justice.gov.uk/courts/pr...ess-statements pictures of the awful signage etc

                      Cases can be found http://www.parking-prankster.com/case-law.html mostly the newer ones are the relevant ones although excel v cutts is one you'll need.

                        I think I need to do all this by 3rd January, not 10th January.

                        also am I right in thinking, that once I have prepared all this and submitted by the said date, that if excel do not pay the £25 hearing fee, then the claim will be struck out?

                          Correct. Just checking you were awake :santa_cheesy:

                          Actually that may help us as BW legal might send it earlier if they close for xmas which gives us a chance to see their stuff before sending yours which would be helpful.

                            as of today i've not had anything from BW Legal.

                            can you advise if:

                            1, Should I prepare and send all my documents now?
                            2, Should I just wait until a certain date before sending it?
                            3, Should I just leave it if they do not reply at all by a certain date?

                                thanks for your reply, really appreciate it.

                                I am preparing my witness statement and I have some photographs of the signs, do i send these off to bw legal, recorded delivery? I've also never done a witness statement before, do I need a lot of detail, or just reference the evidence being used?
