    Vodafone/Lowell V Josh!

    Morning . Unfortunatley it looks like "Lowell" are still chasing me 󾌽 this letter mentions "solicitors", do they mean what they say? Dont know what to think. Its for £1800 which is around 3 years old! I did originally have 3 contracts with them. If i dont respond by 30/08/16 they will proceed with solicitors apparantley. I suppose its alot easier if i phone stepchange/payplan but i dont really want to do that. Hope someone can help......thank you!

      The debt is from 3 years ago and appears to be for £1505.

      So first things first, do you recognise the debt and the amount ? Can you give us a bit of background to the debt please.

          I dont recognise the amount i dont think, basically i took out anither line with Vodafone which was for a sony Xperia z2 24 month contract. 1 day later the phone arrived in the post, opened the box and it was the wrong phone! They sent me the Xperia z1, i obviously phoned them to tell them and they said they would ship the correct phone out the next working day and collect the wrong one.

          However 2 days later, still no phone! I contacted them again and i was told that the z2 phone that i had ordered was out of stock!! I was fuming at the time, i said i wasn't going to pay my first bill obviously because i didn't have the correct phone. They said i had to pay still because it would go down as a "Late payment" and they apologised that there was nothing else they could do! I did refuse to pay my first payment, which i thought was the right thing to do! They then added late payment charge £5 and out of the blue a £5 data charge which made me so Angry, i phoned them up acting dumb and saying this doesnt relate to me and it shouldnt have been put onto my account, which it shouldnt because i had good reason to not pay, i didnt opt for "extra" data when i took out my extra line in anyway what so ever. Finally nearly three weeks later they phoned me and told me the new phone was going to be delivered and apologised again, i found it quite amusing to be honest. I said i didnt want the phone now and they can collect the one they had given me because i dont want to be with them anymore, customer services was absolutely disgusting! I cancelled my DD and i moved over to O2 who i am still with today with no problems!!

          (sorry for huge essay)

            No that is absolutely fine. So as far as you are concerned you do not owe the amount claimed ? Unfortunate that you didn't make a formal complaint at the time but it should all come out in the wash.

            So you need to write a couple of letters, one to Lowell and one to Vodafone. Lowell to tell them the debt is in dispute,you are investigating with Vodafone and to hold off on court action... and Vodafone to make a further complaint and ask for copies of all documents/statements relating to the account and how the debt has been calculated. Will help you with them a bit later on.

            Can you check on your credit file to see if this Vodafone debt appears on there - may be already under Lowell. You can check on a free service like Noddle.co.uk.

            Have you had letters previously about this debt from Lowell/Vodafone since your last convo with them ?

              Well the amount seems to have gone down since July - so that's a step in the right direction

              This is over an old vodafone account which according to Lowell adds up to £1881.63!
              Just to add the background up here too
              Hi. I left before 24 months as several times it had happened there were charges on my account which didn't even relate to me, for instance, £5 data charges etc. They kept removing them for me but it kept happening to the point i got sick of it, i spoke to a "supervisor" at vodafone and told her what i was going to do as it wasn't fair me going through my bill every month and asking why there were extra charges etc thats totally wrong, there's only so many times you can accept an apology. I then informed them i didn't want to be a vodafone customer anymore so i paid the next bill and then stopped using both phones and took out a new contract with O2 and im still with them to this day, with no problems!

                  It says on the letter that if i set up a payment plan or pay it in full it will be reduced too £1505, this could be why they are saying that figure. They do love to be in control dont they.

                    Okay ta. No don't read too much into it but at least it means it isn't affecting you credit score wise for now. It is useful when they do show as you can often figure out the date the debt was defaulted via the credit file, but no matter we can ask Lowell for the default notice.

                      lol, yes. Do you have any idea how much the contract would have been over the 24 months ? £1800/£1500 seems an awful lot.

                        I think it could be because i had three lines with them? They've added all of them together i think! They made a huge mistake and they didn't attempt to rectify it with any goodwill, which i made them fully aware how unhappy i was and so this caused me to cancel the DD which then accounted for the phones i had in my name. I obviously stopped using them straight away when i had cancelled the DD and then left vodafone to go with O2.

                          Can you send the SAR to Vodafone - http://www.legalbeagles.info/forums/...ur-information - that will get all the info you need to defend if they go to court later. They have 40 days to respond with everything. You shouldn't need account numbers just your name, address etc. asking for everything on every account to do with you including all transaction lists, agreements, contracts, screen notes from calls etc.

                          Then we should write to Lowell, but get that sorted first.

                            What happened to the handsets which would probably have formed part of the contract whether you used them or not?

                            When you take out a contract it includes the actual cost of the handset. Sim free handsets are much more expensive to buy because they're not subsidized by the line rental.
