    Hi all

    I received a letter from restons friday....the tone of which was quite unsettling. They are threatening court action over a credit card debt orrigainally assigned to arrow from hsbc. They included a form for details of my expenditure and the letter hinted at a discounted rate to pay back. I am trying to work out the best course of action.

    According to the document they sent me the credit card was opened in 2007 which is right. The account was passed to arrow in 201r (according to restons). They only information about payment (or more specfocally lack there of) is for arrow nothing before that. This confuses me.

    Im 85% certain they last payment to this account was made in june or july 2010....

    My questions are:
    1) what should i do next
    2) how do i do it
    3) should i be worried

    Is this letter stated to be a " letter before claim"?

    Who was the original creditor?

    It would help if you could post a copy of the letter here after removing your name / address and the account number.

        Hi...

        I have asked kati to post a document.

        The origanl creditor was hsbc. There is no refrence to letter before claim...

                        Court claim....restons help

                        Hi

                        Received a court claim form yesterday...

                        The debt is a hsbc credit card with cout fees now just shy 800 quid....

                        About 6 weeks ago i sent a letter to restons solicitors (who are working on behalf of arrow global) asking for proof of the debt belonging to me. They didnt reply.

                        Now i get this form from the court to do with it....

                        What are my next steps?

                          Your first steps are

                          Firstly, don't panic.

                          Secondly, many of these Consumer Credit debt based Court Claims are issued through the County Court Business Centre and are rather lacking in detail and information. The are often claims bought by debt purchasers who don't have the paperwork to back them up to hand and who wing it on the hope that they obtain a default judgment.

                          So, first steps (within 14 days of receiving the claim)

                          1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
                          You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

                          2: Send A CCA REQUEST to the CLAIMANT ( see here )
                          This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


                          3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

                          This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely) You can include a copy of your CCA request with this letter for information.

                          If you are unsure of any of those steps then please make a new thread on the forum (you must be registered to do this)

                          Once those letters have been sent off you should make a new thread on the forum (you must be registered to do this) and make a post titled the claimants name v your username, and containing the date of issue from your claim form, date of service (ie when you received the claim form), type out the Particulars of Claim (exclude account numbers) and tell us the approx amount of the claim. Also tell us any specific disputes or background to the claim you may have. If you know please also tell us the last time you made a payment towards the debt or acknowledged the debt in writing, and confirm you have acknowledged the claim, and what letters you have sent off.

                            arrow global vs tids_69

                            date of issue 22/8/16
                            date of service 24/8/16

                            particulars

                            the claimant claims payment of the overdue balance from defendant under a contract between defendant and hsbc dated on or about 11 july 2007 and assigned to the claimant on mar 28 2014.

                            the value (with fees) now stand at 800 pounds roughly.

                            so according to my credit report nothing exists for this account before arrow took it. however im 90% sure the last payment was made about 6 years ago if not slighly longer.

                            sent the solicitor (restons) a letter asking for proof some weeks ago and got nothing back.

                            have now acknowledge the court papers as required and will be seninf both cca and cpr when the post office opens tomorrow will be sending recorded...

                            So what next?
