  • Parking Control Management/Gladstone Solicitors County Court Claim Form Received

    Issue Date:13 Jul 2016
    £230.89
Claimant: Parking Control Management Slough SL1 2XF
    Solicitor:Gladstones Knutsford WA16 6DG

    A very brief over view.

PCN was originally received given to the driver. 'The attendant recorded that the vehicle was parked outside of a marked bay. The site is private land and operated by Parking Control management.
The vehicle in question was a company delivery vehicle making a delivery to a business which it turned out is on the private land. The driver parked on double yellow lines across from the marked bays with the signs stating permitted vehicles parked wholly within the confines of a marked bay.

I wrote a letter to Parking Control management Slough, with a copy of a delivery note explaining that we were making a delivering and that as I understodd it we had 20 minutes to affect the delivery on double yelow lines.

Being a transport compnay we have a lot of pcn's. Suprising this was rejected so I dug a little deeper and discovered that this was a privatley run firm and that appeal was generally futile. Niavly I did not appeal against this decsion as most of the forums I read concurned that the appeal company and the parking compnay were one and the same.

General forum concensus was that if I ignored the payment request letters the problem would go away.... famous last words. Debt Recouvery Plus sent about 3 generic letters which I ignored and then on 26/04/16 Gladstones got involved.

I wrote to Gladstones and requested a fuly independant appeal, which I now realise is to late, after speaking to POPLA. I requested the details for their case against me.

They replied with pictures of my vehicle and requested that I email in future. I subsequently emailed asking them to aswer the questions I had previously asked. I have not had a response but I have received a County court claim form.

I have attempted to contact the my customer to speak directly to the company we delivered to to get the pcn cancelled but this has not been sucessful.

I do not wish to go to court unecessarily however we can normally load/unlaod anywhere in the UK and not have a pcn upheld against us. If we have stopped incorrectly then I am happy to except that, but I am not sure that is the case here and would appreciate any advise before I head down the wrong path.

    Thanks DonK

Thanks, I have had the letter before claim, which I replied to. This is where I requested the POPLA appeal, but realise now this to late. I also request details of the case against me for which they sent the pictures.

I emailed subsequently but have not had a response to that email. I have now received a Claim Form for Northampton County Court this morning.

Incedentally the intial demands for payment were £160 by the debt chasers this has been changed to £150 by Gladstones, I assume a typo.
