  • Control Account PLC. FedEx import fees.

    Hello,
    This is my first post here so I hope all goes well.

    Basically, last year I purchased an item from eBay and was slapped with a £17 import fee. I was unaware of import fees as the postage didn't mention it. Anyway, a few weeks later I was contacted by a company called Control Account PLC telling me I had to pay these charges by a certain date and that I would be getting charged £10 every X amount of time I didn't pay. I was unemployed at the time so I couldn't pay so I went to citizens advice and they tried to contact Control Account but apparently they ignored citizens advice. Eventually I give in and contacted Control Account PLC on the Wednesday I believe to say I will have the money on Friday (I remember this conversation clearly) and to take it out on that day. They said that would be okay and they will take it out on that day. They already had my details as I had tried to pay them before. So I'm sat happy because my debt is payed off but then a few weeks later I receive another letter telling me I still haven't payed, even though I was under the impression that they were going to take it out of my account on the Friday. I checked my bank account just to see if they were ripping me off, but no, they just didn't take the payment (I definitely had the money). I haven't been in contact with them since that last letter which I got on the 1/3/16 and they haven't tried to get in contact with me. My question is, should I contact them or ignore them? Can they take legal action against me or get bailiffs involved? I'm really nervous as this is my first proper debt :/

      Hi welcome to LB,

      I doubt CA will make a county court claim for £17.00 but this is not a charge it's a tax, personally I would send then a signed for letter with a PO for the £17.00 to get them off your back.

      Make sure you put every detail of the transaction etc. in the letter and enclose a copy of their letter as well to save any " confusion".

        Hi Fletchersketch & welcome to LB.

        My initial thought is, are CA plc acting in the capacity of the 'owner' of the alleged debt, or are they just a debt collection agent acting on behalf of (presumably) HMRC?

        If the former, you should have had a Notice of Assignment (ie informing you that CA are the new 'owner' of the alleged debt.)

          I suspect as an agent as we've seen a few times with FedEx and some other international couriers Charity.

            What right do they have to even charge £10 per day? Sounds like something plucked out of thin air.

            As already stated, pay the £17 and leave it at that as full and final payment.

              Hello again. I would be happy to pay the £17, but now I'm worried about getting in contact with them incase they've added charges and I really can't afford it, if that makes sense?

              The main thing I'm worried about is the threat of legal action. Do you think any bailiffs could be involved at any point?

                If they instruct bailiffs they will need to take you to court first of all and obtain judgment against you before they can do that. Your main argument is that they are not entitled to claim £10 per which they have not confirmed how they have become entitled to these sums if they are merely acting on behalf of Fedex. Secondly, it is unlikely that the claim would be brought to court and if they do, then you could argue that the claim is de minimis i.e. the court does not concern itself with trivial things. Given the amount being claimed, it would not be worth wasting the courts time and resources for such a small sum of money. Although everyone has a right to a fair trial, the fact it is such a small sum and you are willing to pay £17 should be the end of the matter.

                  Ah well that's fair enough. I was just thinking since they haven't been in contact for over 4 month, I didn't know if they had just "cancelled" the debt or if they were trying to set up legal action against me
