  • Employer sending me for training

I've worked for a gritting company for 4 years as an assistant manager. When the job was offered, no qualification or special vehicle licenses were required. 2 years ago the company sent me for a trailer license training (B+E), however I failed. My manager was very disappointed and told me to rebook and pay for the retest myself which would have cost nearly £300. There was no time, the winter season kicked in and it was put on the back burner. My colleagues had passed their licenses so there were enough managers with B+E licenses.

2 years on, my manager has told me he wants to send me for my license again and the company will pay. However, he has stated that 1) I MUST pass because my job depends on it and 2) I will have to pay for all retests until I pass.

Failing the last test knocked me badly, even without having to pay. I was really down for months and the way I was spoken to after failing and then told to fork out for it really made me feel terrible. Besides, I have managed to do my job pretty well without having the license and don't see it as a need. I just feel like I cannot go through the ordeal again knowing that my job is on the line and I would likely be facing and uncertain financial knock in the process. On the whole I'm quite happy in my job, however I am considering resigning if the issue is forced.

My question is: can my employer force me to do the trailer license course in the way he did above and could someone provide a legal basis for whatever answer is? I just want to get my ducks in a row.

    Thank you.
